The “Goods” are goods purchased from Alza via the online shop or other sales channels and received by the customer at an Alza branch, from the post office or another delivery service. The purchase price of the Goods must have been paid in full, the customer must have registered and paid the fee for the extended warranty for the entire warranty period, either directly when purchasing the Goods or following a subsequent offer from Alza. The warranty does not cover Goods that were already damaged at the time of purchase or Goods intended for resale by the customer. It also applies to Goods used for business purposes.
The warranty fee is determined by the amount stated on the Alza website and by the make, model, type and price of the Goods including VAT, which the customer acknowledges when purchasing the Goods. The warranty fee is a one-off payment.
The extended warranty applies for the period following the purchase of the Goods and the subsequent expiry of the statutory warranty provided by Alza or the manufacturer of the Goods, for an additional warranty period of 1, 2 or 3 years depending on the type of Goods. The extended warranty may be taken out for the following periods:
The warranty commences when the Goods are purchased. A prerequisite for the warranty to commence is proof of purchase stating the make, model, type, serial number and price of the Goods and the amount of the warranty fee. The proof of purchase also states the date on which the warranty commences. The customer will receive electronic confirmation of the warranty agreement, stating the make, model, type, serial number and price of the Goods and the warranty fee. The customer hereby agrees to these warranty terms unless they withdraw from the agreement within 14 days in accordance with the applicable provisions of the Distance Selling and Off-Premises Contracts Act. Purchasing the Goods does not require conclusion of the warranty, but the warranty does require purchase of the Goods.
5.1. The warranty ends in the following cases:
5.2. The warranty does not end in the following cases:
6.1. The extended warranty covers financial loss relating to the Goods themselves caused by an electrical or electronic malfunction or loss of functionality of the Goods occurring during the warranty period. The scope of the warranty is identical to that of the statutory warranty and is subject to the same conditions and exclusions.
6.2. Consumables, refills subject to regular replacement, batteries and similar components, as well as other components and parts that are excluded from the statutory warranty or whose service life ends during the statutory warranty period, are excluded from the scope of the warranty. The warranty does not cover software or data stored or used on the Goods in any form.
7.1. A warranty event is an accidental event giving rise to Alza’s obligation to offer the customer compensation for financial loss relating to the Goods themselves, replacement Goods or repair of the Goods.
7.2. “Financial loss” means costs incurred or financial disadvantage suffered by the customer in relation to the Goods themselves as a result of restricted or lost functionality of the Goods covered by the warranty. The warranty does not cover any direct or indirect consequential losses caused by restricted or lost functionality of the Goods.
7.3. The warranty benefit for damage caused by restricted or lost functionality is limited to the current value of the Goods, i.e. the value of the Goods at the time the warranty claim arises. This is determined by deducting 1% of the purchase price from the purchase price of the Goods for each commenced month since the date of purchase. In each year in which the extended warranty is in effect, the warranty benefit subject to this limit may be claimed up to three times.
7.4. To prevent fraud, it is agreed that where no warranty claim arose in respect of previous damage to the same Goods, the customer is required to prove that they had the damage repaired at their own expense. At Alza’s discretion, the warranty benefit will be provided in the form of repair of the Goods, replacement Goods or payment of the warranty benefit. If the Goods have suffered a complete loss of functionality and repair is impossible or impractical, the customer may be provided with replacement Goods offering the same or comparable functionality and whose key parameters most closely match those of the originally purchased Goods. The age and normal wear and tear of the original Goods will be taken into account when determining the value of the replacement Goods.
a) In the event of a warranty claim, the customer must contact Alza by telephone or e-mail (Tel: +43 720 815 999, E-mail: [email protected]) and report the damage. The customer must state the cause, extent and nature of the damage to the Goods. The customer must also provide the details from the proof of purchase showing when and how this warranty was agreed.
b) The customer must hand over the damaged Goods at the designated contact point in accordance with Alza’s instructions.
c) Alza will assess whether the customer is entitled to a warranty benefit and decide on the most appropriate form of settlement. Alza will inform the customer of its decision. The possible forms of settlement are as follows:
d) If the customer is not entitled to a warranty benefit, Alza will inform them by e-mail.
a) The extended warranty does not cover damage caused by the use of inappropriate or faulty software or inappropriate consumables, nor any damage resulting from improper use, even if such use is not expressly excluded in the supplied user manual.
b) The extended warranty also does not cover damage caused by improper operation, unprofessional or inappropriate handling, use or installation contrary to the user manual, or damage caused by an overvoltage in the power supply network (e.g. lightning), except for normal voltage fluctuations.
c) The extended warranty also does not cover damage caused by activities for which the Goods are not intended or which are not customary for the Goods, even if such activities are not expressly prohibited in the user manual, such as mechanical damage to the Goods or electrical overvoltage (visibly burnt components or widespread damage to connections), except for normal voltage fluctuations. The warranty is also excluded where the Goods are used under environmental conditions involving temperature, dust, humidity, chemical or mechanical effects that are outside the parameters specified by the seller or manufacturer. The warranty is excluded in the event of improper installation, handling or operation, or neglected maintenance of the Goods. Damage to the Goods or any part thereof caused by a computer virus, or malfunctions caused by incompatible, unauthorised or illegally obtained software, are also excluded from the Guarantee. The warranty is also lost through the use of incompatible or unauthorised consumables, damage caused by excessive load, or use contrary to the conditions specified in the user manual or other documents provided to the customer, or contrary to generally accepted principles of use. Unauthorised and/or unprofessional interventions or changes to the settings also result in loss of the warranty, as does modification of the Goods by painting, bending, etc. If damage results from such modification, from faulty installation or an upgrade of the BIOS and/or firmware, or from damage caused by natural disasters or force majeure, the customer is likewise not entitled to a warranty benefit.
