The 21st edition of this publication provides an interpretation of all provisions of the VAT Act, including commentary on the provisions of the VAT Act that are amended as of 1 January 2025 and 1 July 2025. This new edition also includes new or clarified interpretations of this Act that have occurred over the last year.
The interpretation of all provisions of the VAT Act is supplemented by a number of practical examples that serve to explain the issues. The publication will therefore be useful to all who encounter VAT in their work and need to understand this subject. In connection with the changes to the VAT Act from 1 January 2025, the publication explains in detail the fundamental change in determining turnover for the calendar year, the consequent creation of VAT payer status by law, and the extension of the scheme for small businesses to include member states where the entrepreneur is not established (the so-called cross-border scheme for small businesses). In connection with the introduction of the cross-border scheme for small businesses, the system of registration of a non-established person is fundamentally changing, the term 'exempt person' is being abolished, the definition of the acquisition of goods from another member state is being amended, and many other related provisions are being updated.
A fundamental change that payers must prepare for will also be the shortening of the deadline for claiming tax deductions. From January 2025, the deadline for correcting the tax base is significantly extended, and an obligation is introduced to correct the tax base and correct the tax deduction even after the payer's registration is cancelled. The approach to the liability of the recipient of a taxable supply is fundamentally changing. A new provision is introduced for the correction of the tax base in the case of a bad debt from a debtor against whom no court proceedings are pending, and furthermore, an obligation for a payer who has received a taxable supply, claimed a tax deduction, and has not paid the provider, to correct the tax deduction for this debt after its due date.
Fundamental changes with effect from 1 July 2025 are occurring for immovable property, primarily changing the definition of a building plot and shortening the time limit for the supply of immovable property as a taxable supply. At the same time, the issue of leasing is also being adjusted.
